These terms are an agreement between you and [OPERATOR] (“Evenline”, “we”, “us”) for your use of the Evenline app and the website at getevenline.com (together, the “Service”). By using the Service, you agree to these terms and to our Privacy Policy.
1. Evenline is not medical care
Evenline isn't a medical device, a diagnostic tool or a crisis service, and it doesn't provide medical, psychological or other professional advice. Patterns and notes in the app describe changes in the data you provide; they can't explain or diagnose those changes. When the app says things changed around the same time, that doesn't mean one caused the other. Always talk to a qualified professional about your health, and never delay or ignore professional advice because of something in Evenline.
If you're in crisis or might be in danger, call your local emergency number. In the US, you can call or text 988 for the Suicide & Crisis Lifeline.
2. Who can use Evenline
You must be at least 18 years old and able to agree to these terms. You're responsible for keeping your iPhone and Apple account secure.
3. Your content
What you enter in Evenline belongs to you. Most of it stays on your device. When you choose to share with a companion, you give us permission to store and transmit those shared entries only as needed to provide that feature. You can stop sharing or delete your content at any time.
4. Companion Mode
- Only invite people you trust. You decide what they can see, and you can pause or remove them at any time.
- If you're someone's companion, respect their privacy: use what they share only to support them, and don't copy, publish or use it against them.
- Companions can add observations. These are personal perspectives, not assessments, and the person they're about can review and remove them.
- We aren't responsible for how people you choose to share with use what you share.
5. Acceptable use
Don't misuse the Service. For example, don't use it to harass, stalk or monitor someone without their consent; try to access other people's data; interfere with, probe or reverse-engineer the Service except where the law allows; or use it in breach of any law.
6. Third-party services
Evenline can connect to services such as Apple Health, Sign in with Apple and Oura. Your use of those services is governed by their own terms and privacy policies. We don't control them and aren't responsible for their availability or accuracy. Data from wearables can be incomplete or inaccurate.
7. Our license to you
We grant you a personal, non-exclusive, non-transferable, revocable license to use the app on Apple devices you own or control, as permitted by the App Store's Usage Rules. Evenline, its name, logo and software are owned by us and our licensors.
8. Changes and availability
We may change, suspend or stop parts of the Service. Features that don't need our server keep working on your device. We'll give reasonable notice in the app before removing features that affect your data, and you can export your data at any time.
9. Ending your use
You can stop using Evenline at any time and delete your data and account in the app. We may suspend or close accounts that break these terms or put others at risk. Sections that by their nature should survive (such as disclaimers and limits on liability) continue after termination.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DON'T WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY PATTERN OR NOTE IS ACCURATE OR COMPLETE.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WON'T BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR US$50. Some places don't allow these limits, so they may not apply to you; nothing in these terms limits rights you have under consumer protection law.
12. Indemnity
To the extent permitted by law, you agree to cover our reasonable costs from claims caused by your breach of these terms or your misuse of the Service.
13. Apple App Store terms
These terms are between you and us, not Apple. Apple isn't responsible for the app or its content, has no obligation to provide maintenance or support, and, to the maximum extent permitted by law, has no warranty obligation other than refunding the purchase price (if any) if the app fails to conform to an applicable warranty. We, not Apple, are responsible for any product, legal-compliance or intellectual-property claims relating to the app. You confirm you aren't located in a country subject to a US government embargo and aren't on any US government list of prohibited parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
14. Governing law
These terms are governed by the laws of [STATE], USA, without regard to conflict-of-law rules, except where the law of your place of residence requires otherwise.
15. Changes to these terms
We may update these terms. We'll change the date above and, for material changes, tell you in the app before they take effect. Continuing to use Evenline afterwards means you accept the updated terms.
